  • Declaring neighbour dispute during sale (Scotland)

I've had a dispute with my upstairs neighbour over his laminate flooring which results in footfall being heard. Under the Standard Scottish Missives section 9.1:

9 DISPUTES/LITIGATION 9.1 The Seller warrants that neither the Property nor the Seller’s title are affected by or are under consideration in any court proceedings or other litigation or are the subject of any dispute.

Would my dispute fall under this? What if me and the owner upstairs resolved it amongst ourselves... would a resolved dispute have to be declared?

    Many thanks
