  • I just found a man in my tree

    Hello,

    I was looking into the back garden and noticed a man climbing in our tree sawing branches off. Some of our tree overhangs into his garden, and his landlord had apparently given him permission to do it.

    I get that you are allowed to cut down bits of tree that overhang into your garden, but in my imagination that means you're allowed to use loppers to cut off overhanging branches - not climb into your neighbours tree and saw bits off it.

    What can I do?

    Presumably that was the neighbour in your tree and not the green man!

    If branches from your tree overhang your neighbour's garden, they may prune back to the boundary line.
    They should offer you the clippings, but you do not have to accept them.
    It does not entitle them to come onto your property to carry out the work.

    The landlord had no authority to give him permission to enter your property.
    He has committed a trespass by entering and cutting your tree on your side of the boundary.

    An unneighbourly thing to do, and one would expect any reasonable person come and ask!

    what can you do?
    Tell him not to repeat the deed!
    If it has damaged the tree you could seek compensation, but be warned even if successful your costs might outweigh any award
