  • Restrictive Covenant

    Hi all knowledgeable ones....!

    There is a restrictive covenant on my property to say that we have to seek permission before making any alterations to the 'look' of the building. It is down as a persons name, or their successor/beneficiary and was made in 1959.

    From google searching I have discovered that the named person has now passed away and their only son has also passed away. It does not seem like there are any other family members/children/aunts/uncles etc. etc. to benefit. It doesn't look like the son had a wife either.

    In this case would I then assume that this covenant no longer applies?

    What should my next steps be?
