    I would love some advice on what to do in this situation.

    The scaffolding was erected three months ago apparently for the purpose of painting the front house.

    I was never asked by my neighbour (who currently does not live in the property, but is renovating it) in advance if it was OK to have the scaffolding in my garden, I was only asked on the day of the scaffolding being put up and it was by the scaffolders who were doing it, and I was given no timescale for this being done.

    I one hundred percent would have refused permission if I knew how long the scaffold would be left in my garden.

    The scaffolding leads right up to my window and could easily provide a point of access for a burglar. The scaffold ladder is poorly protected, only by a thin piece of plastic and some tape. I am very concerned that the scaffolding poses a serious risk to the security of my home.

    Also I live on a street with lot of young families. I often see children playing in the street and am very concerned that a child may try to climb the scaffolding and there is no fencing around it, and no-one is currently living in the house. In my opinion this is an accident waiting to happen.

    I have explained my concerns to the owner who has told me she has been unable to contact her builder. I therefore asked her for her builders number and she would not give it to me. There is no tag to identify the scaffolder on the scaffolding.Today I asked her about it today and she sys she needs some more work done on the roof and someone would come around to do it soon.

    I have contacted my local council and they say that they cannot deal with it because it is a civil matter.

    I am at my wits end of what to do, firstly because of the danger of the situation, but also because I need to do some work on my garden, and am unable to because of this scaffolding.
    Can I deal with this in a legal way?

    As you gave the scaffolders permission IMO your best course of action is to write to the owner telling her that permission has now been withdrawn, and the scaffolding must be removed from your property forthwith.
    Warn her that if she does not comply you will within 7 days apply to the courts for an injunction, with an order that she pays for the cost of the injunction.

      Thank you so much for the quick reply. I will definatelydo this. If the scaffolding isn't gone within 7 days do I need to call a solicitior to organise the injunction? could you advise how this is done?

            Dear neighbour (her address),


            I am writing to immediately withdraw any permission that myself of my partner have given you to erect scaffolding on my property.

            You must remove the scaffolding completely, and with no damage to my property immediately

            If you do not do not comply within 7 days from the date of recieving this letter,my solicitor will be applying to the courts for an injunction, with an order that you pay for the cost of the injunction.
