  • Witness in a court case against a neighbour and being harassed

Hi everyone, I was just looking for a bit of advice as I’ve run out of people to turn to.

Back in July I had to phone the police on a neighbour as he was attempting to damage a guests car and then racially abused him as we intervened. I am now a witness in an up and coming court case regarding this and as such the neighbour has bail conditions to not contact me. Since this incident, my car has be scratched multiple times, my partner harassed in communal areas of our flats and glue put in our locks, all of which the police have taken no further action on. On one occasion he followed my partner around outside at 2am in the morning wearing a balaclava.

We had also made complaints to his landlord about his behaviour and he has just this week served with notice that a section 8 antisocial behaviour eviction notice will be issued within two weeks. I should point out that this man suffers mental health issues and has care workers etc assigned to him.

Upon being issued this letter he had a meltdown and was taken away by care workers and placed in temporary accommodation but we’ve been informed by another neighbour that he will be returning to the flat soon. That neighbour has also sent us a screen shot that states that his “collaborative workers” are preparing for retribution against us as it is a perfect time as he is out of the way.

I honestly don’t know what to do. We don’t feel safe and his care workers don’t seem to care that he is a danger to us. Council are uninterested also. Any time we have gone to the police about his behaviour it has been brushed aside. Because my partner isn’t a witness to the case she isn’t covered by bail conditions so when he was harassing her it wasn’t taken further. I’m at my wits end and don’t know what we can do to just put and end to this madness so if anyone can point me in the direction of what to do next I’d be very appreciative

You need to consult a solicitor and obtain an injunction and or a restraining order.

Sorry about your problem. Unfortunately, all I can suggest is try to move somewhere else.
It may be defeatist but through no fault of yours I think it is a very precarious and volatile situation. Sorry again.
