  • Property /Death

    Hi
if I had a house that I bought with my ex partner but she never moved in and only paid half the mortgage for 4 years and never paid any maintenance towards it and then I died is she entitled to all of the house as she is on the deed even if I made a will stating I don't want her to have the house.
    Thanks

Depends on whether you owned it as Joint tenants or tenants in common

This is what is in section B. Does this mean it is tenants in Common?
3 (30.01.2001) RESTRICTION: Except under an order of the registrar no disposition by the proprietor of the land is to be registered without the consent of the proprietor of the Charge dated 19 January 2001 in favour of National Westminster Bank PLC referred to in the Charges Register.

No, that means NatWest have a charge on property.... presumably a mortgage.

The Title Register Document shows the names of the people that own the property and, if you are tenants in common will also have wording similar to: "No disposition by a sole proprietor of the registered estate (except a trust corporation) under which capital money arises is to be registered unless authorised by an order of the court".

If there is no such wording in the Title Register Document then you are almost certainly joint tenants.
