  • Boundaries and Criminal Damage

    My neighbour erected a fence on our boundary line a couple of years ago after some disagreement between us. This Christmas I attached some small LED fairy lights on the fence along the edge of our drive. After night before last these were cut in two places so now do not work. I have a security camera on the side of my garage which indicated that there was activity at 02.30am which lit another outside lamp and there was a glimpse of a hand on the fence, and also as the camera records sound, there is unmistakable footfall sounds at the same time, all from his side of the fence. No one walked up the drive. Whilst I have no conclusive proof I am convinced it was him. Have I any justified legitimate complaint in this and can I take it further? I have obvious doubts but will value any advice.

    I would stringthe lights to some posts just your side of the fence. Neighbour disputes can get expenive and difficult. Then at least if the lights are cut it is aggravated trespass and criminal damage.
