I finally “lawyered up” (apologies I know it is solicitor in the UK) and can add the following. It appears my neighbour owns a portion of the back yard over which I have right of access. This was not updated on the land registry title plan thus leading me to believe I owned the whole back yard. I procured the deeds from my bank which show an assignment early 1900’s.
The back yard is about 18ft deep. After ignoring my solicitor's maths (clearly not his strong point) I worked out around 10ft from the back of my property belongs to me and the rest belongs to my neighbour.
Over lockdown the alarm was triggered at my property. I went to investigate to find a tenant from next door hammering a sheet into my fire escape to act as a sun shelter. The fire escape is wholly on my land and is my property. This is what prompted to get legal advice.
Currently my solicitor has written to the land registry requesting compensation/fees for their error and is awaiting my instructions to write to my neighbours about my wish to construct a wall separating our respective areas. Fees are mounting up so I would like a little advice before I instruct him further.
Can I build a wall separating our yards? If so and it is around 8ft from the plot boundary would I need planning permission?
Would I need to inform the neighbour if I build wholly on my land?
Would I need agreement with my neighbour on exactly where the boundary is? Would this require a boundary surveyor? What would the likely cost of this be?
Any other comments on anything I should be aware of are greatly welcomed and thank you in advance.
