  • Transfer of Property - Unmarried

    Hi

    Hopefully someone could give me some advice on the best way to go about a transfer of ownership.

    Situation
    House and mortgage both in ex partners name (unmarried)
    We lived here together for approx 15 years and I have remained a further 5 years
    I have spent 10s of thousands on the property and always paid 50% of everything
    We also have a Deed of Trust stating I am sole beneficiary.

    Can anyone advice the best way to change legal ownership, not just beneficial?

    I presume the other party is in agreement? You will need to use a solicitor to do the conveyance as a mortgage will be involved. You will need to obtain a mortgage in your own name then the property can be conveyed. Probably cost around £600 or so if its straightforward but I'd advise getting a few quotes. Get a mortgage agreed in principle before incurring costs.

        If you get it in before the end of this financial year no stamp duty. Other than that I don't know. HMRC website is quite good. You could check on there.
