    I think I need to understand better what the legal test should be here. The application planning statement says that the applicant has been using the building to run a business for more than 10 years. It also says that the impact on the highway is nil as the team of people working on site would have generated less traffic than a family living in a dwelling. I know this is rubbish, the building has only been visited a handful of times a year and then normally only by the owner. However, Class PA only says that the building must have been used for business on 19 Mar 2014. He has clearly submitted some evidence of this which I am not allowed to see. He has also submitted a response to my objections which they won't let me see either. The Council seem to be basically saying that they believe his evidence and that our claim that the building hasn't been used for the last 10 years is not a material concern. Our argument of course is that he has submitted false or misleading evidence and this together with him asking us to allow him to falsely claim that he had been using our toilet should shed doubt on the rest of his evidence. I thought I also read somewhere that they could refuse to consider the application if they believe the evidence to be false or misleading
