Are conveyance legal documents enough to determine a legal right of way

    Hi, thank you for any advice in advance.*

    I have in possession two conveyance documents from the solicitors dated 1975 and 1977 respectively. Both buyers and sellers have signed each document and they both have been stamped by both the inland revenue and HM Land Registry.*

    In the documents, it states:

    ALL THAT dwellinghouse land and premise being known as (insert my address) on date, delineated on the annexed plan TOGETHER WITH (so far as the vendors are able to convey the same) a right to pass and repass over the piece of land coloured yellow on the said plan to gain access to and egress from the rear of then property.*


    This right to pass and repass is over council land but there are no signatures from the council.*


    Are these documents sufficient in law to confirm such right of way?*

    Check the land registry file for the servient land to see if the necessary notice has been entered.
