    If you hold a short hold tenancy agreement, is the land lord allow to evict you immediately with out any time notice?

    A few more facts are needed to make any constructive comment.* However, under normal circumstances a 2 month written notice is required, known as a S.21.* If you are in rent arrears of more than 2 months, the landlord can apply for a S.8 which would mean he may be granted a possession order in court. The court will then inform you of the date you must vacate.* I must stress though without knowing the facts it is difficult to give you any further advice.

      The land lady (letting agent) said if your landlord sees the state of the flat he will imidently evict you

        More facts/details is needed about your TA, one line sentence are not much help !

        Have you signed a AST, how long you lived there for, where does your landlord live, did you pay a deposit was it protected and so on.

        A LL needs to serve correct notices on a tenant, obtain a possession order and in the End bailiffs remove a tenant which all takes time

        Illegal eviction penalty

        England and Wales

        Illegal eviction is up to 6 months in Prison or Fine or both upon conviction at the Magistrate Court, Section 1 (4) (a) 1977 Protection from Eviction act.

        Up to 2 years in Prison or Fine or both upon conviction at the Crown Court, Section 1 (4) (b) 1977 Protection from Eviction act.

        Tenant can sue for damages/harassment in the Civil Court for illegal eviction Section 27 1988 Housing act.

          Yes I have an AST hear! I have been hear for 14 months.
          The Landlord agent lives in elderley edge cheshire and the land lord lives in ashton under line

          I dont know about the deposit as the concil paid it

            Then from what you posted so far

            The LL/LA would have to serve you written notice/ correct forms if they want possession of the property, which will take time.

            If they do ever serve notice on you, take the paper work to Shelter, CAB or a Solicitor office so they can check the forms and advise you accordingly...

            You cannot be Evicted immediately by a LL/LA, its and Criminal and Civil offence for do so.

              Thanks for the links, but is there anyway at all thyat they can evict you on the spot?
              the LL/LA are very good at twisting facts you see

              But if it is a criminal offence to be Evicted immediately then who regulates this? is it a police matter? do you know where I can get reference to it being a criminal offence?
