  • Constant noise from a local factory

Does it constitute a public nuisance since it is affecting roughly 40 homes in it's immediate vicinity and also a local health centre and park.

For the past five weeks now heavy machinery sounds have been coming from a nearby factory. We asked them to sort it out and over the course of a week got six different stories of why, when, how etc without success. Several of us have contacted the council's noise pollution dept but it is like banging your head against a brick wall. They have even tried to say they have not witnessed a nuisance despite visiting my property and saying it was, despite visiting the factory on several occasions and asking them the install acoustic insulation around the machine and despite the factory telling them this had been done only for them to (reluctantly) visit and and say that what had been done was not adequate.

If you (and your neighbours) are dissatisfied with the action your council have (not) taken you can take action yourselves.

You have the option of the magistrates court or suing in the county court for compensation.

To see what your alternatives are i would suggest a read of this site: http://www.environmentlaw.org.uk/rte.asp?id=31
It will save me a lot of typing
