  • Planning Permission Obtained With False Evidence

    Is it possible to get planning permission revoked when it has been obtained by false evidence and declarations?

    Retrospective planning permission was recently granted on a replacement outbuilding that will in future be used for accommodation based on 2 pieces of false information. Firstly an easily proved false legal declaration, secondly by falsely claiming a reduced footprint when it is actually nearly twice the size, also provable.

    Although I have now seen the legal declaration, it was not made public for comment on the planning application. The planning officer ignored all objections and comments relating to history, use and size of the outbuilding.

    You'll be lucky to get the LA to revoke PP.
    However The Town &Country Planning Act 1990 sec 97 - 100 gives the LA power to revoke or modify the permission to such extent as they consider expedient. Compensation payable as per sec 116.
