Sorry but I did do a serious letter.

I asked for their complaints procedure .........but none sent. I have given them dates of payments and how they were made and asked them to proove oterwise but they just keep demanding!

Who can I complain to now?

This is all from Capstone who are the administrators for a mortgage with SPML.

I have had issues with late payments in the past but for the last year they have all been on time.

The problem they say is their banking system has had a shake up and it has shown that several customers have actually had payments taken back bye the bank and now are in arrears to Capstone.

The trouble is they do not seem to know much about the missing payments but are just going straight in with demands.

I have written asking for their proof but they ignore this and just say I owe. I have written giving them dates and methods of said missing payments but they claim that my CASH payments made over the counter have been taken back which I don't understand. Firstly because how can that be and secondly these were not csh payments and I have shown them that.

They are threatening to register these missed payments with the CRAs and state full payment must be paid or they will alter my account and add the amount to the outstanding mortgage.

I am just so frustrated as I have not missed these payments but they are not interested in listening despite them not seeming to know where exactly they have arisen.

In that case send them an SAR, then you will be able to see if they have you confused you with somebody else.

Those records will be worth seeing.

Hmmmmmm this is very suspicious.

Stupid question time as I'm sure you have already done these.

Have you contacted your bank and asked them if they have had any payments returned ?

Have you checked your bank statements to make sure the payments have actually been made.

When you wrote to Capstone did you enclose copies of the statements showing the payments ?

Did you enclose copies of the cheque stubs ?

Amy - I think that is a good idea and will get that done asap

Sapphire- I have not sent them copies of anything yet as I was told last week by them that they were complying with my request for proof and to be honest I don't trust them one bit.
As they don't actually seem to know what payments were refused ie they are saying in one letter it was dd and today she said it was cash payments, I feel they need to be the ones providing the proof.

I will do the sar and if I get anymore letters I will send copies of my payments but to be honest I don't think they will believe that!

I would also be sending another very stern letter asking again for details of their complaints proceedure . I would guess the FOS would be your next step but make sure your paperwork is all in order now so you are ready to send copies of everything.

I would also be putting in writing that you are not happy with speaking on the phone and you want everything in writing in the future.

Hit them with everything you can as you dont want your credit rating to be affected if they are wrong.

On the 11th I received a letter from SPML re my complaint.

They say they are committed to excellent customer care and are sorry that I feel I have been unfairly treated lol

They have included a statement of the mortgage and a statement of arrears.

I have spent the last 2 days going over it but it is so confusing. Anyway they have asked for my bank statement for the 2 months that they dispute so will copoy them minus most details.

I have also worked out on the statement of arrears that it appears that their bank actually failed to call for the DD's on several occasions but they have charged me £25 each one as a failed DD. My bank statements can prove that they were not called and I intend to query this and ask for a refund.

There are also lots of odd pennies and amounts here and there, its a complete mess!

Sent a letter and coies of statements and also pointed out they charging failed dd fees when in fact they hadn't called the dd's!


Sent my copies of bank statements etc back to them and stated that they had been charging me unpaid dd fees when in fact they had not called the dd's.

Have not had any reply to this so far.

Today I got a mortgage statement.

They have added 2 payments of £350.24 to the mortgage balance and the balance as of 23/11/08 shows a credit of 25p.

Over the page on" Summary of your total borrowing" it states arrears of £750.44 and also includes a £50 arrears management fee!

Also the difference between Amount charged and Amount paid is £75.92.

The outstanding amount of the mortgage includes the 2 failed dd's that have been added.

Can anybody work this out?

I can't work it out from what you've said. Maybe if you posted up scanned copies of your mortgage statement we could try.
