    Hi Grimbell

    I too had a mortgage from SPML/Capstone they were never slow in telling you if you had missed a payment first letter was normally a few days after the the payment was due then it was a constant stream of letters after that and we got regular mortgage statements from them.

    Not sure how that information is going to help you tbh just thought I would let you know as it seems strange it has taken a year for them to contact you about this.

      I know usually within a couple of days either a letter or phone call that's why I don't understand this.

      Obviously someone made a mistake but I don't understand why it has taken 13mths for it to come to light!

        Do you have a copy of your bank statements from that time ? worth checking I would say

          I have and it's not good!

          About this time A&L closed my account without notice and cancelled all my dd's. It does show that this payment was returned but another went through for a different amount.

          My issue is they should have picked this up earlier surely. Also due to a dispute with my employer I am facing a very lean couple of months and finding this extra payment will be very difficult especially as they are likely to add the usual £50 admin fee.

          I have made great efforts over the last year to make all payments on time in the hope of being able to re-mortgage but this will b***er it up!

          the so and so's have just sent a letter stating that there is to be an increase in their charges and that will now be £60 per month!

Yes I agree with you it should have been picked up a lot sooner

            I know the feeling Grimbell, I no longer have a mortgage, I am renting now but I was like you the £50/£60 monthly charge is a joke just watch they don't add a charge for an adviser to come and talk to you as it was £100 not sure what it would be now. Saying that the adviser never did call I was still charged tho
            You have just reminded me going to look into all the charges I had with them.

                Had a letter from them. Did not contain an explanation or the proof I asked for.

                What it did say though was that now my arrears are £700 because they have found another unpaid dd from Dec 2006!

                Have check my files and have proof that I paid by cheque!

                Sent another prove it letter stating that I am appalled and find them unfit to deal with my mortgage.

                The numptys!!

                  You really do have to watch them dont you!
                  In the good old days of the mortgage payment book at least you had your stamped stubs so there was no argument.!

                    Sent a proof it letter ten got a pone call to say they were addressing my letter but would take time to supply their proof.
                    The next day I get a phone call and a letter saying pay up!

                    Have written again given dates of all the payments and told them if they continue to contact me in the manner that they have been I consider it to be harassment and will report them for it.

                        Have just had another phone call to say I am now £1200 in arrears!!!!!!!!!!!!!
                        Not being in the best of moods I was not very nice to te girl and told her that is completly wrong. She says that aside from oter arrears this months payment has not been paid!
                        I told her that I have an agreement to pay by the 10th and payment went yesterday!
                        She says that I need to sort the rest out.
                        Told her I have sent aletter with dates of payments etc and they should check it out before continuing to harass me.
                        She says the bank system has shown none payments for several people and they are correct and I owe them!
                        I then got made and said no I bloody don't so she says ok well how about we cancel the agreement to pay by the 10th then!
                        I then ask for her name she says no I say I want your name she finally gives it and still insists I owe them because when I paid by cash over the counter the bank have taken it back!!!!!!
                        I tell her I didn't pay either of those payments by cash and they need to read the letter and check their facts before continuing to harass me or I will report them.
                        She then says bye and hangs up!

                        Sorry for the rant but this is really getting to me now.

                        Who do I go to now?

                          Clearly, you are not getting anywhere ranting down the telephone at a call centre worker. All you are doing is upsetting yourself.

                          Take your time and write them a letter and ask them to detail all these payments they say you owe and what dates if you have missed (if any). If you have proof you have paid some of them, include this in your letter and don't speak to them again if they call you.

                          Have you sent them the harrassment letter with regard to telephone calls?

                              I have already written to them to ask them to give me the proof that these payments were missed.

                              They have given me two dates Sept 2007 and December 2006.

                              I have written giving them the dates of all payments made at these times....Sept 2007 2 payments made by DD and Dec 2006 one payment by cheque.

                              They are saying my cash payments were refused!

                              The only reply to the letters (that they say they have received and I have receipt for) are more demands to pay up!

                              I have my mortgage statements and they show the payments have been made.

                                They need a serious letter to stop them harrassing you. They can't do this to you if you don't owe them anything other than future payments.
