Can someone advise what I should do next.
I was at the hearing today for the record of examination, and there are numerous lies within the defendants sworn document (EX141) that I can prove.
Also the stupid court staff failed to submit my own additional questions which they now admit was a mistake and are now having to approach a judge for yet more court directions. The number of errors in my case is truly shocking, with judges suggesting Drop Box is used for document submission, only for the court staff and the very judge himself admitting they don't have access or know how to use Drop Box, so clearly the judge wanting to appear cleaver, but is just as thick as the court admin staff.
Then there are judges directions setting orders with dates in the past, (quite how anyone can work in their time frames in beyond me), and this is just the tip of the iceberg, which has been capped off today, by the staff admitting they didn't subsequently check the file before attending the EX141 examination (quite why it is called an examination is a joke, they didn't ask one question, they just took his word for it), and now having reviewed the EX141 content, it is riddled with lies that I can prove.
So effectively the defendant has lied under oath, as he has to swear on site that everything contained in the EX141 is the truth and clearly it isn't.
He claims for example that the company is being wound up and is with his accountant, but that isn't the case, and companies house shows that there are late submissions, and I have made a submission to Companies House, showing he company owes £5000,00, and as a result the company cannot be wound up. He has also lied that he didn't take any assets out of the company, when I know he sold his company van after the curt case concluded when he then legally owed me money, and he kept the proceeds. He has also stated that as the creditor, I am not pursuing him for the money he owes, but I am. The form is full of lies.
What do I do now. This is or was supposed to be a simple small claim, but has now been in the courts incapable hands for nearly 3 years, 3 years, for a small claim, all because of the incompetence of the court staff, nothing more nothing less.
