  • Advice on 2 civil cases please

    Hi all,

    Can someone give me some pointers in the right direction please. To cut a long story short, basically my son in law and his partner both owe me over £7000 after i borrowed them the deposit for athier house, they are not paying me any of the money and havent done for over a year and a half, the other thing is that this same son in law borrowed some of my possessions about 5 years ago and now due to the falling out about the money wont return them.

    These items are of enormous sentimental value , in fact id say i was more bothered about them than the £7000 (not that im rich -far from it!) as they are irreplaceable to me.

    So now due to him and her being so obnoxious i have decided i must go to court, do i need a lawyer who specialises in civil litigation? if not that, then what area of experience should i look for?

    Im assuming there is some legal mechanism in court to get either my property back or if not try and get an order for their current value (which would be around £3000 i guess, but id hope that would facilitate their return to me, rather than pay that sum out)

    I know you can do MCOL - i can do that for the money but what about the items of mine that they wont return? i honestly dont know where to start about those.

    Any adivce is appreciated

    Regarding the items I would suggest a letter to SiL demanding return of loaned items within say 2 weeks.
    Warn him that failure to deliver and you will apply for a court injunction to force return of the items, and for an adverse costs order

      If you have loaned the money, and one evidence for a loan is some repayments on it, it occurs to me that it may possible to put a charge on the house to secure the loan - others with more experience of land law might wish to comment about that

        Is there any evidence that it was a loan? If not it can be claimed that it was a gift. I have successfully obtained repayment of a loan via the small claims court but I had created a deed and had full documentary evidence.
