  • Subject Access Request vs Disclosure?

    Hi, should I wait for directions on Disclosure or file a DSAR in accordance with the Data Protection Act 2018? (it is the same information). Thank you!!!

      In a court action you would normally deal with disclosure under the disclosure directions. The SAR rules were not intended as a tool of litigation and the obligation on the disclosing party is not the same. For instance I do not think that there is an obligation to release a copy of a particular document.

        Sorry I haven't logged on for ages. It is worth knowing that the only reason the other side can withhold evidence in a SAR (whether litigating or not) is if there is a valid exemption in the DPA 2018 or GDPR.*
