  • When does Default Judgement get entered?

    Hi,

    I requested Default Judgement on Christmas Day via Moneyclaimonline, and was wondering is it an automatic process or do staff need to be there to action it?

      It is actioned by the court. You wont get default judgment until the court opens again in which case the defendant could still have time to file an acknowledgement and/or Defence.

          Does anyone know when the County Court Bulk Centre reopens please?

          And is there any way to have them process the Default as soon as they are open?

            They will process it when they get round to it and eventually issue the required paperwork. Can take a while.

              My understanding is that only if the Defendant filed a Defence BEFORE I requested judgement, will it apply. Does that sound right?

                Generally, that is true, however until the courts have actually recorded that a default judgment has been granted, I've seen courts accept defences that are late. Even if the court takes the proper view that a default judgment should be granted, the defendant could still make an application for relief from sanctions and get the default judgment set aside, which the courts have accepted particularly if the defence is a day or 2 late.
