  • Small Claim question

    I am the claimant in a small claim.

    The hearing date has been set and both parties had to file statements and documents with the court by a certain date and exchange with each other.

    I complied, obviously being the claimant and I assume the defendant has filed at court otherwise I would assume the defence would be struck out and I would win by default, but this date was nearly 4 weeks ago and I haven't received anything from the defendant.

    How is this looked upon by the court and how can I get the defendant to give me their documents and statements etc.? Is there a court protocol I have to follow or a form I can fill in?

    I have difficulties and am unable to phone the court for advice.

    Anyone can help, I would be grateful, thanks.

    You really need to contact the court and ask them for the status of the claim. If you're not able to phone try and find an email address or failing that, write a letter.

      The court can advise you of the status of the claim but will not give legal advice.

        I have emailed the Court two weeks ago, but other than a automatic reply, they have not responded.
