  • Advice request - I won a case...

    ...in the Small Claims Court, by default, about six months ago.

    It was against Royal Air Maroc.

    They have an open company listing on Companies House - here - Company No. FC005385

    But I cannot get them to pay this default Judgement. I have tried and tried and they just ignore me.

    Advice peeps? Preferably avoiding enforcement proceedings.

    Civil Aviation Authority?

    They also have offices in New York, and I am there in a few months - could I take the default there and ask a Judge to enforce it in NY? Or to make an equivalent USA Judgement?

    If they ignoring you,you could try a DCA, but they probably won't fare any better.
    Cannot see any alternative to enforcement via the courts.

      If over £600, have a word with the Sheriffs (HCEOs)

        Do you read anything into the above Companies House listing?

          Companies House regard the company closed because of lack of filings. See here
          Governed by the law of Morocco.

          Basically you have no chance of success, sorry.

                I made a claim for my replacement clothes after they lost my luggage for ten days.


                Sent all receipts, etc. Three months later they refused to pay anything unless I sent the clothes I had bought back to them.


                By which point I had given to a charity shop.


                Is this normal practice people? Do other airlines do this?


                I have Googled and searched online extensively and can find no other case like this, and further, AA and BA luggage departments both tell me this is not something they have or would ever do.

                  Doesn't matter what they want
                  If the judgement you obtained says they must pay you £xxx, that is what they have to do.
                  If they wanted the clothes they should have filed a counter claim and attended court

                      The clothes argument is a red herring.
                      The court has made a decision, end of.

                        Which clothes did you give to a charity shop? The ones you bought as replacement for the ones which went AWOL for ten days?

                        Were the items/clothes which were lost temporarily by the airline eventually recovered and returned to you?

                        Did you have any travel insurance which may have covered you for your loss? This may have been unobvious if included in a packaged bank account etc.

                        How did you pay for your plane ticket? If it was by credit card then section 75 of the Consumer Credit Act may enable you to make a claim from them since they may have joint liability for your loss. If you've got a CCJ then get the credit card company to enforce it.
