  • Apportioning Costs

    Does anyone know how the opposition’s costs should be apportioned in a case where I won against the Claimant and lost against the part 20 Defendant? Both were represented by the same solicitor and barrister.

    If you could point me in the right direction I would be most grateful.

      Righto Here Goes

      The defendant can recover all costs for the main action from the claimant excluding Part 20 costs
      But
      Any "common costs" are likely to be apportioned on a ratio decided by the court.
      The Part 20 defendant can only recover costs of the Part 20 claim as well as "common costs" as above.

      All this also depends on wht the Judge has ruled in costs, as something may have been laid down in the claim or decided in court.
