  • NHs 18 Right to treatment

    Good Evening all

    Please forgive me for this post i know most of you will consider this to be a post that is not worthy of a repy but if you bear with me you hopefuly will see that i have a complaint that needs to be addressed

    This complaint is against the NHS 18 week right to treatment, although the original problem stems from a private provider commisioned by the NHS

    In May for some reason i had a leg injury i do not know how, i called out the Emergecy Dr as i could not bear ony weight on my leg at all and could not stand,13 Hours Later the Emergency Dr arrived spent less than two minutes with me and the diagnosis was inflammation in the knee, two weeks later and very severe pain in my knee i went to my own gp she refered me to the private provider for an MRI scan.

    After 8 weeks i decided to contact said provider and i was told NHS patients come after private patients and i would have to wait my turn, you could say i was shocked and very angry and to my shame i made sure everyone at this provider knew it.

    A trip back to my Gp to make a complaint against this provider she was fuming and arranged an Emergency scan in 2 Days the complaint was passed on to the Leeds CCG who contacted me to find out what had happened , results of the scan indicate i have a torn Medial Miniscus with a piece flapping about in my knee preventing me from straightening my leg and from walking without the aid of a crutch and severe pain.it seems it is a degenative problem and nothing else

    Now this is where the NHS took over,my GP made a choose and book appointment for me to attend for treatment i went on to choose and book website and i had to make an appointment to make a telephone appointment to the MSK team this was to be 6 weeks after my choose and book letter, more pain 6 weeks later telephone appointment arrives and i was informed that they would now make me an appointment to see the MSK Team and that would be a further 8 weeks, i made my frustrations pretty clear at this point and i was asked to calm down which i did afterall it was not the Ladys fault on the other end of the phone, i told her i needed surgery as i was already informed by the Gp who deals with these injuries and could i be refered straight to the Orthopedic consultant and no chance was the reply

    Well a week ago i had that appointment and it was confirmed MSK could not help me and have refered me to an Orthopedic surgeon for Surgery but wait for it my appoint ment with him will be in 12 weeks

    So after this long winded post i have completely missed the 18 week right to treatment and i really dont understand what happens now,has anyone with any experiance with the NHS and treatment times

    Hi and welcome.
    Sorry to hear of your problem,and can appreciate the agony!

    I think you may have misunderstood what the 18 week right actually means.
    It is not a right to treatment, but right of referral to consultant led treatment, which stops and restarts at appropriate points.

      Im sorry i do understand that it is the right to consultant led treatment,but as i understand it the only treatment available to me is Surgery and nothing else therefore consultant led treament is surgery is it not ?or have i got it wrong. I have read that the Consultant Led treatment does include all tests and any treatment as needed and must be done within the 18 weeks unless clinically appropriate to wait longer

        The NHS Constitution sets out your rights as an NHS patient. These cover how you access health services, the quality of care you receive, the treatment available to you, confidentiality and your right to complain if things go wrong.
