    Hello, would someone be kind enough to help me with a question,
    A homeowner dies, six days later three family members add their names to the title deed as tenants in common. The house was then put up for sale, a few weeks later a probate application was submitted that included the 25% share of the deceased. The gross value of the estate was given as £87,630 and a net value of £73,179. Is this Legal ? many thanks Sue.

    HI and welcome.

    Are you concerned about possible fraud, avoidance of inheritance tax or diminution of your legacy?

    Did these persons add their names to make it appear they, together with the deceased were tenants in common, or did they register themselves as owners following the death of the deceased?

      I have to ask

      Why have the added their names to the title deeds??

      They would automatically be a beneficiary under any will left/probate

      Was a will left??

        Hello, many thanks for your replies, Yes, I think it was a way of avoiding any tax. The house wasn't then part of the estate. Thanks again Sue.

          Hello yes a will was made and all 3 family members are Beneficiaries, the reason for adding themselves to the deeds is unknown, many thanks Sue.

            So they have attempted to defraud the taxman, and have probably forged the deceased's signature on a land registry form AP1.
            Whether or not you report your suspicions is your decision.

              A update on this we now know a TR1 form was used in October 2014 where the deceased gave the 3 beneficiaries together with herself her estate now 4 owners, I have contacted the Land registry they have confirmed they only received the TR1 forms after her death in February 2015, reason given on the TR1 was for the love of my children, in June 2015 the owners of the property was still all 4, is this right as no IHT has been payed on the full estate it seems just the deceased share, thanks once again Sue.

                Mt understanding is that as the gifts were made with 7 years of death IHT is payable.
