  • Liability order/summons

    Hi, basically been disputing an amount of 300 pounds from 2011 with council for unpaid council tax for 4 years. It has gone to tribunal 3 times and been struck out through lack of evidence from them. Next thing I know got a liability summons obviously as they cannot win in a tribunal. I just need to know if the order is granted do you receive a letter advising you of this or will a balliff but sent without warning. The issue I have is not the amount its the principal I have disputed this all this time and find they can still slap this order on me, also I know I do not owe this money and the underhanded tactics the council have used over the last 4 years to get me to admit I owe this range from topdog ringing my home phone on a sunday morning with scare tactics to getting me to sign a letter they dumied up asking me to sign admitting I owe this I wonder how many other people have been bullied by councils. Pls advise

    Is it just the summons you've received (saying they are going to apply for a LO on a certain date)? They usually try and word those as though you shouldn't turn up at the 'hearing' ... this is because they take a fair few into a room and get them 'signed' without the need for anyone to read the facts first. If you turned up, they'd have to have an actual hearing :tinysmile_twink_t2:

      I didnt go was on sep 1st sent letter to court etc will the council have to advise me if this is granted.

        If you haven't gone then chances are it has been granted :sorry: ... council's don't need to show there is an actual debt just that they think there's one :sad:

        You'll get a letter informing you of the LO (hopefully before bailiffs are contracted to collect) and will have to come to some sort of arrangement to pay

            If you'd have gone to the court on the day of your summons you could have probably got it stopped dead in its tracks :tinysmile_hmm_t2: However, you might be able to challenge it on the ground of the three tribunal results. You can always try contacting the CEO of your council with a formal complaint citing the three tribunals?

            How come it was thrown out at tribunal three times?
