  • Incorrect liability order

    Hi I hope someone could help me. 4 years ago I received a council tax letter stating I was in arrears to the sum of 299.00. After checking my bank statements I was not in any arrears I still had the original bill. Since 2011 I have been disputing this with the local authority it even after I appealed went to a tribunal that was struck out as the council could not provide any evidence. That was last year then today out of the blue I received a liability summons for the amount what can I do now its not correct I owe nothing when I called the court they told me they dont get involved and to contact the council. Surely how can I be took to court when I dont owe this any advice would be welcome.

    Is what you've got the summons to go to court (not an actual liability order)? If so ... I'd suggest you turned up at court on the day to fight it (councils hate that)

    Other than that, formal complaints to the CEO (or equivalent) of the council enclosing proof of payment and copying in your local MP is an option.
    Debt is like any other trap, easy enough to get into, but hard enough to get out of.

    It doesn't matter where your journey begins, so long as you begin it...

      In my experience, these cases don't actually go to court and are an attempt to frighten you into agreeing a repayment plan. I've been to one where you just sit in the court waiting room until called then sit in a room with council officers who want to get an arrangement.

      For this reason a guy in London recently got a court ruling that councils can't charge you for a court hearing when they don't happen. It's just a scam to raise money.

          Hi, yes over 4 years I have every email, letter and reply. Thanks to all taking the time to help me i have hit a brick wall
