  • Advise on sar

New to site. Think I posted to wrong section.

Had a personal injury claim against a national company. I stupidly didn't get any legal advise and went ahead and made a settlement. It was all rushed through with no advise from them only to sign settlement agreement. My fault. I am now after an sar from their data base for any information they have about the settlement. Reason being I want to know if anything untoward in rushing it through went on. The company I claimed from had two other company's working on it for them. A management company and a loss adjustment company. Both of these company's have told me they have files about the case but can not release them without the permission from the company I claimed from. The company I claimed from have said they will give me the information I need. Could anyone advise me on what to write and ask for.

    Hi

Firstly, be carfull what you say, lots of settlement agreements with companys like these have none disclosure conditiions in. Nothing you have said above would be a problem, just keep it in mind.

    Your SAR

Usualy, but not always, one company will nominate to be the data controller for the others ( prob claims managment co or insurance co ). The SAR to them, should get everything, But.

Anything they consider to be part of investigations could be withheld. any comunications with there legal dept. So what your looking for, if it exists, could e withheld by them.

Your SAR is easy to do, you can get the basics from here. http://ico.org.uk/for_the_public/personal_information

They can charge you £ 10 for the data
crazy council ( as in local council,NELC ) as a member of the public, i don't get mad, i get even

        Re: Advise on sar

I had a personal injury claim and have asked for a sar. I have been told that they should hold my information for six years. If this is correct would this be from the start of my claim or from the date it was settled. I would be greatful for any advise.

        Thank you.
