I agreed with a scaffolder to have a scaffold erected for work beginning 9th June. After many, many failed promises here we are on 1st July and it is STILL not finished although they managed to find time to send a bill. The painter has been very patient but may have to leave without finishing the job. The roofer arrived with a gang of men and said that what HAD been done was not at the correct height. They now won't take my phone calls. All I want is for them to finish so that my tradesmen can do their job. If they had finished yesterday I could have had the job done by the end of this week. What do I do? All suggestions gratefully received.

S1 have failed to fulfill the contract.
You have suffered loss due to that failure.
You might engage another scaffolder (S2) to remove S1's scaffolding and erect their own, properly.
You might then sue S1 for the cost of engaging S2.
You might seize S1's scaffolding as security for the loss.
S1 is also in breach of consumer legislation.
Put these points into a Recorded Delivery letter to S1 and give them a deadline to complete.

Hello Enquirer. I fear I may have to do this. The only problem is, and I think they know this, I had dreadful trouble getting even S 1 let alone another to dismantle (or whatever).
