  • Permisson for friend to deal problem.

    Hi all, looked to see if I can see a sticky for this. My friend is having problems with a Hire Purchase company, they have asked me to help to deal with it, ie writing letters and dealing with the problem. What does she have to tell the company, so they deal with me.

    I have done this for others on a number of occasions. Your friend needs to provide two documents - Authority to Act and Authority to Disclose Information.

    The Authority to Act should be worded something along the lines of -

    To Whom It May Concern

    Authority to Act

    I [Your Friend's Full Name] of [Your Friend's Current Address] hereby authorise [Your Full Name] of [Your Current Address] to act on my behalf in the matter of [Description of Matter] between myself and [Name of Hire Purchase Company] of [Hire Purchase Company's Address] and that [Name of Hire Purchase Company] shall deal with [Your Full Name] in this matter until such time as I revoke this authority in writing.

    Signed:........................................... .........
    Date:............................................. ......

    The Authority to Disclose Information is to stop the Hire Purchase Company using the Data Protection Act as an excuse not to co-operate and should be worded something along the lines of -

    To Whom It May Concern

    Authority to Disclose Information

    I [Your Friend's Full Name] of [Your Friend's Current Address] hereby authorise [Name of Hire Purchase Company] of [Hire Purchase Company's Address] to disclose all information it holds on me to [Your Full Name] of [Your Current Address] in the matter of [Description of Matter] as [Your Full Name] shall so require until such time as I revoke this Authority to Disclose Information in writing.

    Signed:........................................... .......
    Date:............................................. ....

    You send a letter, enclosing the two authorities, signed in ink by your friend, to the Hire Purchase Company, introducing yourself as your friend's representative, making it clear you have been asked to deal with the matter on their behalf and enclose Authority to Act and Authority to Disclose Information and that the Hire Purchase Company should address all correspondence in the matter to you.

        It depends a lot on what the matter has been. On the whole, if someone gives written authority to someone to act on their behalf and sign it in ink, the organisation that is being dealt with cannot really refuse to comply. If they were to refuse without good or lawful reason, the regulatory agencies can be brought into the fray and asked to intervene.
