  • Help with charging order

    Haven't been able to keep up with my ccj monthly payments as i have lost my job and have now received a interim charging order for the middle of January not sure where to go for help I am so cross with myself

    can anyone help

    Unfortunately because you have defaulted on the Judgement order, they can and will obtain a charging order.

    Can you give a bit more info.

    Is the property in your name alone
    Is their equity in the property
    What was the value of the CCJ
    What were your monthly repayments
    Do you have any children/dependants

    You can't stop the charging order from being granted, but you need to ensure that they can't apply for a sale order.

    The judge has to grant the CO because you defaulted on the CCJ, but he does have the power to grant it with restrictions which will prevent any further enforcement action.
