    I was made bankrupt in 2008, since then with a fight i have had my bankruptcy annulled the case was brought by H.M.R.C. against me and they admitted they were wrong and applied to the courts for a annulment some 5 years later, my question is in there statement to the court one of there solicitor stated in writing that they " Would put me in the position i should be in had the order have not be made" they have failed to do this, was this statement made by them a legal and binding statement bearing in mind it was part of there case for the annulment hearing.

    Write to the firm of solicitors and remind them they have an obligation to compensate you for their mistakes and you will be expecting payment from them within a reasonable period of time and that if they refuse you will take legal action to recover your losses which will incur further legal costs and interest on top of what they owe you.

    Wait for their reply, if they fail to respond then find a solicitor that specialises in professional negligence to make a claim against them.

      Thanks for your reply, maybe i have not been clear enough and for that i am sorry, It was the solicitors within the revenues offices made the statement in writing in the court the day of the annulment hearing that the revenue " Should put me in the position that I would have been if the order had not been made" they have not and all i get is excuses from them, I have had enough now and if this statement is legal and binding I intend to take court action. I am sorry to say but this site has given me more useful information than any of the solicitors i have spoken to and I thank the users of this site for all the help given

        Do you know the names of the solicitors involved? If so, you could report this to the Solicitors Regulation Authority (SRA) and it would indicate whether or not they were still practising as solicitors. As for HMRC, did the court make an order and give HMRC a time-limit in which to pay and in what sum? To the best of my knowledge and belief, HMRC is not exempt from being found guilty of Contempt of Court. Incidentally, which court made the order against HMRC?
