    Hi I'm new to the site and would appreciate any assistance.:yo:
    I am a named beneficiary on a Irrevocable Trust Fund set up by my parents some years ago (they are still alive) I signed the document along with my brother and believe that the main residence of my parents is within the trust. My question is do I have a legal right to have a copy of the Trust as I signed it and I am a beneficiary. I asked for a copy from the solicitor and he said I am not entitled to see it without parents consent. I am now rather suspicious as at first solicitor said he knew nothing about it etc. This story changed quite a lot over the course of a few telephone calls. Any thoughts on what I can do would be appreciated.

    The simplest solution would be to ask your parents for their consent to obtain a copy of the documents you require from the solicitor.

    It would be in your best interests to get all the information regarding the trust and any wills that have been drawn up by your parents while they are still alive and double check the contents because one of the next big scams to come to light is 'Will Writing Services', where the wills are written and then changed to make the writer, or one of their associates, the beneficiary of the estate and once the person whose will it is has passed on there is no way of confirming the details as true or not and a stranger could walk away with your inheritance.

      Thank you very much for your reply. My parents are very elderly, I have not asked them for their consent as I know it would worry them,
      they will get alarmed if they thought anything was untoward. The main reason I asked for a copy was that my mother has dementia and
      I wanted to see where we stand about future funding for help if she needed it (residential care).

        Have you considered becoming power of attorney for your mother, or asking the Social Services to appoint an advocate, to speak or act for her because of her dementia?

            This is not a good sign.

            As Labman indicates, you are normally entitled to copies. If the solicitor continues to be obstructive, then you must take firm action, and soon. As already suggested by IanM, acquiring a Power of Attorney would also be a wise move.
