  • PCN from Civil Enforcement Ltd - Wrong time limit of PCN

    Hi there,

    I've recently received a PCN from Civil Enforcement ltd for being parked in a co-op car park for more than the three free hours. I was there for more than three hours, but on the PCN it says that the time limit was 2 hours. I'm appealing on the grounds that the PCN contains incorrect information and is therefore invalid. (enclosing a picture of the parking sign)

    Can anybody tell me if this kind of incorrect info on a PCN does actually render it invalid or is the appeal unlikely to be upheld?

    In this case I assume PCN is Parking Charge Notice. Incorrect signage is a genuine for appeal. Back it up with the photographs and any other things you can think of.

    I would not openly admit you were there for in excess of the three hours.

      Why not ?

      A free car park so unless they can demonstrate that his parking caused them a loss (he stopped another customer getting in) then the damages are nil are they not ?

        The post says three hours were free. Anything over that I assume had to be paid for? Another ground for appeal may, of course, be the lack of any ability to pay an over-three hour fee if that were the case.

          Interesting. Thanks for the replies. In my appeal letter I did accept that I had been there for over 3 hours as they have pictures (automatic number plate recognition when going in and out of car park I would imagine) There is no facility to pay if over three hours. it was also on a bank holiday and the store was closed was part of the time I was there (in the park next door).

          I haven't heard anything so far - long may it continue!

            Photos of your vehicle entering and leaving a car park are not, in themselves, conclusive evidence that you have parked there. A PPC would, IMO, struggle to prove you had parked there on such photos alone. They would need to have timecoded photos of the vehicle actually parked in a parking bay. However, due to a parking person altering details on a photo of a parking sign and timecoding on a photo of a vehicle parked near the parking sign, a few years ago, which resulted in them being jailed for Perverting the Course of Justice, IMO, a court would want to see some pretty conclusive evidence of any alleged infringement of parking conditions as well as actual loss before they would order a motorist to cough up to a PPC.
