hi just joined, desperatly need some advice,, my poor mum age 66 has been stopped at tesco for shoplifting and because she pleaded none guilty as advised by solicitor they are taking her to court... please read the rest before you judge her

my mum is 66 years of age , and not once in those years has she ever done any thing wrong, she is such a lovely, kind person who i wouldnt expect any one in our small town would have a bad word for, any way this particular day , unbeknown to us she has been worrying about my dad who has been diagnosed with a aneyusm in his chest which they will keep eye on , but if worsens could kill him or he will need a serious operation which will mean heart stopping. they hadnt told us this as , my sister 7 years ago lost her voice box due to a rare aggressive cancer, so i think they thought do not worry us unless have to... any way , her mum died of this sudden aneusym 4 years ago, so she has had all this stress and worry on her shoulders thinking my dad will go the same way, this day she went shopping my dad had been complaining of pains in arm chest etc, but wouldnt call the docs, my dads one of those oh its a bug....
but my mum is a bad worrier, she rushed round tesco getting a bit of shopping , my sister had asked her to get her some cough throat spray when she went in next so had that on mind to get, some how and shes not sure how , she always takes one of the large bag for lifes in trolley and she was seen on camera putting the stuff for my sister in the bag, but all she can think in her daze was she was thinking thats hers keep seperate, her mind truely wasnt on her shopping this day, anyway after getting through the tills, she was stopped , she was so shocked and upset and couldnt even remember putting it there.

the security were so awful to her, its a shop she goes in most days and staff prob know her well, they called the police.... the goods were worth 8 pound

anyway she had to go to the police station the day after and had a duty solicitor, who advised her to say how it was that she was sorry if had taken them but was done in error and explained all what had been going on..
we were then shocked 2 week later to be told they are taking her to court, the solicitor is also shocked for that amount and because never done a thing wrong in her life
all im asking please is a little advice on what is likely to happen if she pleads not guilty, will they then send it on to crown court?
im so worried about her as she is so distressed, not sleeping, her mind doesnt seem her own she has even gone to the doctors today for sleeping pills, im scared the stress of it all will kill her she has lost so much weight and looks frail,

we are a family who have never been in trouble so really do not know how things work, shes so scared it will go in the local paper
thank you for any advice x

how awful. I am sure someone will be along to help soon. And I do feel for her - I was once in a shop with other worrying things on my mind and I walked straight out of the shop with the basket on my arm. I was so lucky that I realised ( no alarms in those days ) and turned round and walked back in. But I was mortified about how distracted I had been.

Rather than worrying that the story might get into the local paper, she could be better to take her story to the local and national papers!

        Why?

Well, she was obviously in a vulnerable state of mind at the time, which both the staff at Tesco and the Citizenry Persecution Service really should have considered. Then there is the question of whether it is really in the public interest to waste thousands of pounds of taxpayers' money on such a trifling and trivial case.

Tesco and/or the CPS should be leant upon to drop the case PDQ.

What about trying to get the attention of the CEO of tesco as suggested - does anyone think they would have any influence in stopping the prosecution at this stage? they have a facebook page for complaints perhaps we could try and get an email address of someone high up? and give them a bit of bad publicity at the same time?

not really sure, she heard nothing for two weeks from the police as the one dealing with it was going on holiday ! so left to stress for 2 weeks, then she had to ring them to see what was happening as she was getting distressed we told her to phone them, any way he came down and said it was going to court, said if she had said she was guilty would have been a small fine and caution probably, but at the end of the day she was being honest when she told them she hadnt done it intentially, she said have you explained to tesco why it happened , he just said no, as they wouldnt let her explain on the day, i know security doing job, but any one looking at her would know shes not your normall shoplifter. she was so upset when he told her she was going to court , she said cant it just be handled out of court ill pay a fine, he said no out of my hands , so not sure who pursuing it, even the solicitor was mad and said like to know whos pursued this
