  • Particulars of claim

    I have brought an action jointly against Santander and Mercedes Benz dealer following failure of a suspension strut after only 20,000 miles.

    The judge has ordered that I file and serve particulars of claim by 24 April and I haven't got a clue how to do this.

    Help anyone please?

    Difficult to assist really. The problem is we dont know the exact order made by the Judge nor do we know the facts of the case.

    The Particulars of Claim are the particulars of your claim against the Defendant, the legal and factual basis why you have a claim against them.

    Are you relying on s75 Consumer Credit Act ?

      I know F-all about cars because I'm a woman But I do know that it's worth checking out car *recalls* on the internet before making a formal challenge. I got BMW to replace the gear box on my daughter's Mini after accepting (under pressure from me) that the defect on that year's model was subject to a recall in the US (which has higher standards) but not in the UK.
