Re: MBNA letter before action - help needed

    Thank you for your help.

I think we sound like we are in a very similar position. It is not straight forward for me and I can not afford to go to court for personal reasons. I did get court papers from Cabot back in December 2011 for an overdraft on the bank I banked with for over 20 years! They sold me out and I ended up having to do a F&F with them but it was not a great amount. I now have another (same bank Yorkshire) who at the same time sold me out with my O/D sold my CC with them to Cabot. I was paying them £1pm until a few months ago after I was told it was UE. Cabot are now getting a bit close for comfort but, I am sticking it out until the last minute if possible or if they back down with the EN/UE of this debt.

I do know that Cabot (if they know 100% they are right) will get you in court before you can say their name! On the account they have (YB CC) they have gone back to the YB twice to see if they could get 'a better CCA'!!! They didn't get a 'better' one so have stuck with the only one they have got. Even though I have no agreement with Cabot to pay £1pm I have just been doing it to keep them off my back. If I miss a payment by 1 day they write to me saying I have broken the 'agreement' with them, and then when I pay they write and say I haven't got an 'agreement' with them!? I do think if they wanted to take me to court they would have done this by now but they are very unpredictable and you never know what they are going to do.

Lowell are muppet's as are most of the DCA's and do what they want to and get away with it too in most cases. If it wasn't for sites like this there would be a lot of very scared, poor people around with the bullying and ripping people off.

Keep me up dated on what happens and how you get on with Cabot..

      Hi Trixie
Yes you are right Im sure I would of been to court too
Cabot said they had cancelled my agreement and were now looking into other ways of recovering their debt then they wrote to say pay us the £9 you have defaulted on or we will default you seeing has Barclays never did and take you to court
What for £9 when I pay what I can muppets
