    Hi everyone,

    quick question re my final charging order as outlined previously.....

    Natwest via shoosmiths have recently sent me a letter saying that

    "seeing as they have a final charging order, they have been instructed to negotiate payments to reduce my liability rather than with continuing with further enforcement and that they are unable to accept the payments until we can assess whether or not they are reasonable....therefore we enclose an income an expenditure form and ask that you complete this asap"


    Are they legally allowed to do this? The judge stipulated the terms of the final charging order as being an instalment order and that as long as we paid instalments on time then Natwest would be unable to ask us for more money........

    Can you please post up the final charging order from the court but omitting your personal details so the team can give you further advice.

      The terms and conditions of the judgment order/charging order have been set by the judge, this is now your agreement with the bank. They cannot alter this agreement without the judges permission.

      therefore we enclose an income an expenditure form and ask that you complete this asap
      Only a court can make you provide personal information about your income.

      Tell Shoosmiths were to stick their I&E.

      As long as you comply with the judges order they can do nothing.

      It could be that your payments are not covering the cost of managing this account. You may want to consider negotiating a full & final, offering 10% in return for discharging the debt. You may be in a stronger position than you realise.

        Many thanks and apologies for my late reply.

        I haven't responded to shoosmiths as I had a feeling it was only the court that can order I&E. Shoosmiths have mentioned in the letter that they'd like to come to some sort of arrangement but we haven't any savings so I'll await their next move. Thanks for replying, Lilly
