  • Defending a claim for costs?

    Hi All

    First post, so please be kind.

    Moderators if I have posted in the wrong section, my apologise, please move it to the correct section.

    Real quickie....

    On what grounds can costs for solicitors fees and court costs be defended?

    Is it an automatic right to expect a claim for costs to be awarded?

    Can you explain if you have a court hearing? Whether you have a costs order against you?

      This is dependent on which court you begin the action in. Legal costs are not usually recoverable in the Small Claims court. However, even here I have recovered costs, and had costs awarded against the business I used to work for. With claims allocated to the fast track and multi tracks, costs are usually recoverable (to a point) from the losing party.

        Should have said in original post.

        Family court (county court). Change of residence order to which I agreed.
        No costs order. Ex went a bit mental in court and had an argument with the judge.
        I was ordered to put forward a defence in writing to the courts and ex.

        No sols involved so don't really know what I am doing.
