  • Who Do I Sue ?

    Can anyone help me with this please, I'm lost here. This might seem double dutch, but here goes-

    If for eg Cynthesys was the trading name of 3 Limited companies

    Cynthesys mail order Ltd

    Cynthesys stationery Ltd

    Cynthesys systems Ltd

    Cynthesys website says we are a partner led company, so this suggests its a partnership. If you wished to issue proceedings would you sue the partnership or would you make a claim against all 3 limited companies as they were all involved involved in the causes of action, and how should it be shown on a claim form?

    Is it a legal partnership, for example, a Limited Liability Partnership, or is the partnership label simply a trading style of the Limited Liability companies?

    A Partnership can be legally recognised and thus sued, but make sure you have a cause of action against it, or your claim may fail.

    If you wish to sue more than one defendant, you simply make them co-defendants (sometimes termed "second defendants") and include this on your N1.

    What is the claim for?

      No its not a LLP

      Their letter headings used to show a longer trading name but changed to a shortened name a few years ago, but all of the 3 limited companies had a finger in the pie.

      Cant post details on open forum, is there a private area I can use please?

        Think Im being a bit thick , but I'm still a bit stuck on this, any help appreciated.

        I know there are a number of partners in CYNthesys, and its a partner led business, but its been pointed out to me that this doesnt necessarily mean that it the company is a partnership. Its not LLP, and the business consists of 3 limited companies.

        Is a Trading Name the same as Trading as?

        In a nutshell if CYNthesys is the trading name of CYNthesys Mail Order Ltd and CYNthesys Stationery Ltd, would TRADING AS need to put shown after their limited company names when naming them as defendants on a claim form.
