  • Protective Writ

    Can anyone help me please.

    I need to know how to issue a High Court Writ to protect a limitation period.

    I understand that particulars of claim don't need to accompany such a writ, as they can follow within a 3 month period. Ive also been told that the only case details required to be entered on a protective writ are the pleadings, and the amount of damages sought do not have to be declared at this stage.

      Hi
      The link above refers to writs of execution to enforce judgments. It doesnt give any info on the process of issuing a protective writ.

          Telephoned the court a couple of weeks ago, the official tried to be helpful, but didnt really have much of a clue. All the court sent me was a blank N244 and a leaflet.

          Just been advised though to study CPR, Part 7, 7.2, 7.4, 7.5 and 16.2
