We are defendents acting in person, ie no solicitor. The Claimants solicitor have sent us a WP part 36 offer, which states that they will settle for £27k against a claim in court of £37k app. This sum is inclusive of interest but not costs to be assessed in default of agreement on the standard basis. HELP what does this mean??
Also we do not wish to accept the offer to settle. We have a substantial counterclaim in the case. We had previously made in writing a lower offer to the claimants solicitors of £20k, without costs, which we thought fair.
However we do not really wish to continue the case, even though we are acting in person, expert witnesses will have to be paid as the next stage, and we do not want to waste money. But is there a detriment in the "courts eyes" if the case has to continue, and we lose, will their offer go against us in eventual judgement??
