    Hello - would appreciate any insight from a legal standpoint.

    My grandfather is nearing the time where he will have to take residence in a private care home. This will require funding - my mother ( his daughter ) has power of attorney with regards to finances and health. My grandfather lacks capacity has he has progressive Alzheimers.

    He currently resides with his partner of the last ten years. She has become very obtrusive when it comes to his finances - my mother has access to his bank accounts and is trying to figure out how much my grandfather can afford with respect to future care costs.

    There is a box where he resides with paper copies of shares that he owns, amongst other financial paperowrk where there is no digital record and my mother has asked, repeatedly, for this box to be made available to her so she can calculate my grandfathers assest. The partner has resisted these requests, and has gone so far as to say that she wants to share the contents the contents of this box with her own family ( nothing to do with our family) before she will consider giving is access to the documents.


    Do we have any legal recourse to recover the paperwork? We have up to this point never had any concerns around her access to his finances but we are beginning to worry that beyond obstructing the person from POA from acting in my grandfather's best interests, that the partner may have misappropriated or manipulated my grandfather's finances- though we have no proof of this currently, our main concern is recovering his financial documents in full that she is intent on not allowing us access to.

    Do we have any legal recourse to recover the documents and how mught we go about this from a legal standpoint?

    The attorney may take legal action to secure delivery of the documents to her. This would be a claim using Part 8 of the Civil Procedure Rules. Professional assistance advised.

      As a way of getting an idea of what should be in the box when you eventually get it, you should be able to see dividend payments from the shares he has dropping into his bank account. From that info and info available on the relevant company’s investor website you should be able to work out how may shares he has in each ( by dividing the payment received by the relevant dividend per share amount). Alternatively, under the authority of the LPA you could contact the various share registrars ( there are only a few) to find out what holdings he has. There may be uncashed dividends or other entitlements to claim if he doesn’t have his dividends paid direct to his bank. The major registrars are Computershare, Equiniti and MUFG (formerly Link)
