    My father had a stroke and he cant manage his own money. I am having to get a deputyship for him so I can manage his money. We want to use some of his money (£50,000) towards buying a another house with myself (I will put in about £350,000) to move closer to his daughter in another city. Is there any way that I can take that money and use it now, rather than wait for a deputyship? He is happy to do this its just that he cant do it himself. I am sure the answer is no just wondering if there is any legal way around it.

    Having a stroke does not mean a person automatically loses mental capacity.
    You should write to his GP/hospital consultant and ask for their professional opinion on your father's mental capacity and his capability to understand important decisions.

      As advised above this all hinges on whether he has the legal mental capacity to make the decision to gift you £50k. As you are applying for deputyship there may be some doubt about that. If he has legal mental capacity why would you need to apply for a Deputyship? He could just give you power of attorney and gift you the money.

      I don't know what you mean by "He is happy to do this its just he cant do it himself". What is it he can't do?
