    I need urgent guidance on a very distressing situation.
    Back in 2022, my friend Mr.Smith visited a fortune teller who told him that I would win the lottery in August of that year and then deny it to him.
    August came and went, and I did NOT win the lottery.

    Since then, Mr.Smith has been harassing me relentlessly. He’s sent countless threatening emails and even pushed vindictive letters through my mother’s door. The worst part is he emailed me threatening to have me shot outside my child’s school, in front of my kids.
    The police have confirmed and logged all this harassment.

    I am currently out of the country, but my mother recently went to check my house and found a bailiff letter demanding £11,000. It claims this is following a court action. However, when I contacted the court, they told me this isn’t their doing and that it’s a private matter between Carl and the bailiffs (DCBL).

    Here’s the problem:

    There is zero evidence to supsupport Mr.Smith's bizarre claim.

    This whole thing started because of a fortune teller’s prediction, which is obviously ridiculous.

    I cannot understand how bailiffs have accepted this case without any proof.


    What I need advice on:

    1. How can I stop this immediately before it goes any further?


    2. What steps can I take to challenge DCBL and prove there is no legal basis for this debt?


    3. Can I make a claim against Carl for the years of harassment, threats, and emotional distress?

    This has been going on for 3 years.

    The impact on myself, my wife, and my children has been a living nightmare.




    Any legal guidance, next steps, or advice on how to handle both the bailiffs and Carl would be hugely appreciated.

    Such a bizarre story, and it's your first post here, I'm sure you'll understand why I might suspect this is a wind-up (we get those). But for the moment I'll take it at face value and offer a couple of comments.

    DCBL operate both as debt collectors and as baliffs. Being a debt collector is a private agreement between them and somene who claims you owe them money. The person claiming you owe them money does not have to prove anything to DCBL-as-debt-collector nor to have won a case in court. Anyone can hire a debt collector.

    Being a baliff is entirely different. Baliffs are acting as officers of the county court and can only be appointed by the creditor after they have won a court case and a judge has ruled in thei favour and allowed them to use a baliff to enforce the judgement [CCJ].

    In this case there appears to be no court judgement so DCBL are just acting as debt collectors. Debt collectors have no legal power or authority to do anything and you can simply tell them to go away.

    But it is curious that DCBL say there is a court case against you. It's not like DCBL to actually make up that statement if it isn't true.

    Please can we see this letter from DCBL. Post it on here after covering up your name and address and DCBL reference numbers, anything that might identify you. I'm not going to offer further comments until I've seen that letter.

    As for the rest of it, if what you have posted is the full and accurate story it is complete legal nonsense. You don't owe "Mr Smith" anything.
