  • claiming against partners insurance

my daughter was a passenger in her boyfriends car, they had an accident and she suffered whiplash. they rang insurance people to see if she could claim off her boyfriends insurance but they said he has no legal aid on his policy so she cannot claiim. is this correct!!
also could she claim free legal aid through normal channels as she is currently unemployed and clAIming jobseekers allowance??
    many thanks

    Re: claiming against partners insurance

I am guessing she would be able to pursue a claim using a no win no fee personal injury firm.

It also depends who was at fault with the accident.
Any opinions I give are my own. Any advice I give is without liability. If you are unsure, please seek qualified legal advice.

who's fault was the accident? If it was the other party's fault she should be able to claim through their insurance. If there was no insurance she would be able to claim through the Criminal Injusries Compensation Board (or something like that) When I had a car accident, the other driver (who's fault it was) gave a false name, could not be traced etc, but I still made a claim and was paid out. My insurance company pointed me in the right direction.

1)She can sue the driver, but i'm pretty sure it will be her ex boyfriend then.
2)Ideally though, The boyfriend should have reported to his insurance at the time of the in0 cident that someone was injured as well, so they could effect a claim on the 3rd party.
        3) Get the 3rd party details and make a claim against them direct
