Can anyone explain why government departments who are defendants have not served their defence within time limits? In both cases I served them with Writs and Statements of Claim, they then served me with Notice of Appearance but failed to served me with the defence. Is this normal for cases involving government departments? Is there any motive behind their lack of action?

Apply for default judgement and then see what they say.

    Cock-up cannot be ruled out.
Lawyer (solicitor) - retired from practice, now supervising solicitor in a university law clinic. I do not advise by private message.

I have applied and been granted default judgement. I have to wait until I receive the paper copies, so I can apply for unliquated damages assessment.
