  • Contesting judgement after default

    Hi, if a a claimant gets default in their favor, and then the defendant decides to make an application to contest, must they send this application to the claimant as well as the court?

    Please read cpr 23.7 Service of a copy of an application notice
    23.7 (1)(b)
    A copy of the application notice must be served - at least 3 days before the court is due to deal with the application unless a different time is stated in a rule, practice direction or court order

    Served means send to the other party
