  • care company refusing to replace item they lost.

My grandmother has a care company provide carers to her home to aid her in her day to day life. 1 of these carers accidently dropped her dentures down the toilet and flushed them. The company is refusing to pay to replace them and is saying my grandmother needs to claim on her home insurance. Where does she stand?

The care company is liable for their employee's negligence.

If your grandmother has insurance that covers this loss, a resolution might be for her to make a claim provided that the care company agrees that it will pay her excess or pay for the cost of replacement if this loss is not covered under the policy.
