I was arrested within the last month by police officers who came to my home following me asking a family member for help during a mental health crisis I was experiencing. I asked family to call me an ambulance as I had recently (following my doctors instructions) reduce my mental health medication and was, amongst many things experiencing severe problems with anger/rage . The reduction in this medication I believe resulted in me experiencing severe emotional volatility. I felt unsafe and needed help.
Rather than an ambulance being sent, the police arrived and I was arrested under suspicion of common assault, criminal damage (I slammed and broke a bit of a park of a garden gate). I was later (whilst in police custody) arrested for coercive and controlling behaviour.
There is CCTV footage (via a camera I installed many years ago) that they obtained from my family members’ phone) that the police have of me slamming this gate – this was used in my police interview.
To cut out A LOT of detail, I was released on police bail, with pre-charge conditions stating I could not go back to my home, and could not contact said family member.
Said family member is now in a mental health crisis of their own. They are contemplating suicide and in a very distressed state. The police and supposed support services have offered little to no support whatsoever.
The duty solicitor the police arranged for me told me prior to my interview to stay completely silent, which I did. I tried to contact the duty solicitor after being bailed but he advised he was not able to offer any more help due to his resourcing issues.
I am now, a month on, have no home, I was allowed to go back to my home (where I also run my business from) to collect some of my tools and belongings, after arranging this via a solicitor/investigator.
My biggest concern is said family member is now in a desperate state, they are of ill health and all they want is for this to be resolved - they never wanted me arrested and certainly don’t want these bail conditional imposed. They feel a lot of guilt and received no support at all. I have been advised of this from a mutually connected friend, as I can’t contact said family member.
Family member was never consulted about these “pre-charge” bail condition imposed on me and they have received little to no support from the police, or the agencies that are meant to help.
In fact, family member has sent several emotionally distressed messages to me, but due to fear of being arrested, I have not responded to them. This has been VERY hard on all of us.
I have now appointed a solicitor from a well-known law firm who has been trying to contact the police/investigator involved, as has my family member, but nothing is being done or messages responded to.
I am VERY concerned about family member, as they now, from what I have been told, feel tremendous amounts of guilt for trying to get me help I asked for, and both family member, my current solicitor and me can’t seem to get any response from the investigator involved or the police force.
Please PLEASE can someone offer some advice so that I can, at the very least, get these pre-charge bail conditions lifted so I can help my family member, as I am worried about their safety.
My bail conditions state I can have no contact directly/indirectly with family member nor visit the property I lived in.
